Some judges take coffee breaks without reason, Supreme Court proposes to investigate the performance of High Court judges

The Supreme Court expressed its desire to know how much work all the High Courts of the country are doing and what is their “performance output” (quality and quantity of work). The court also questioned the habit of some judges to take frequent tea and coffee breaks. The court said that if the judges just take lunch breaks and work continuously, then their performance and the quality of decisions can improve.

Justice Suryakant said, “We want to raise a big issue, what is the real output of the High Court? We spend a lot of money on the justice system, but how much work do we actually get? Some judges work very hard, which we are proud of, but some other judges disappoint. They get up repeatedly for tea, coffee or other breaks, whereas they should only need a lunch break. Working continuously will improve the results.”  

This was said when a division bench (a two-judge bench) of Justice Suryakant and Justice N Kotishwar Singh was hearing the appeal of four convicts. The Jharkhand High Court had completed the hearing on the appeal of these four 2-3 years ago and reserved the decision, but the order was not pronounced.

Later, after the intervention of the Supreme Court, three convicts were acquitted and in the case of the fourth, the judges had a different opinion. Nevertheless, all four were ordered to be released from jail. Looking at this case, the Supreme Court paid attention to the big issue of delay in pronouncing the verdict. The court said that it is necessary to follow the fixed time limit for pronouncing the verdict and some new arrangements will also be made for this.
